Sterling Personnel, Inc is recruiting for a Staff Attorney for our client, located in the Corpus Christi, TX area. This position will be responsible for assisting in developing department policies and procedures in compliance with Bankruptcy Codes, General Orders, and Local Rules. This is a full-time position with an expected schedule of Monday through Friday from 8:00 AM – 5:00 PM. This is an exempt position under FLSA.
 
The ideal candidate for this position will possess basic knowledge of non-bankruptcy laws, must be capable of conducting evidentiary hearings in Bankruptcy Court and is self-motivated with the ability to analyze complex problems and situations. 
 
Staff Attorney Responsibilities:
  • Appear before the Court and represent the interests of the Trustee in all divisions and ensure that staff members handle all matters pursuant to applicable federal laws, rules and procedures as well as local rules and procedures, and create tools to assist staff in learning processes and procedures.
  • Examine legal documents including notes, deeds of trust, security agreements, leases and contracts.
  • Drafting and filing pleadings pursuant to the federal rules of civil procedure, federal rules of bankruptcy procedure and local rules, such as motions, responses, orders, and objections to confirmation and exemptions, etc. 
  • Review overpayment matters; draft demand letters, motions, orders for turnover, applications for attorney’s fees, loan applications for approval/denial, Motions to Incur Debt and to Sell assets and file objections when necessary. 
  • Recognize, investigate, and prosecute matters involving illegal or fraudulent conduct that might occur in connection with a bankruptcy case, such as creditor fraud and debtor’s failure to disclose.
  • Recognize, investigate, and prosecute allegations against attorneys of improper representation and illegal or unethical practices and refer legitimate complaints to appropriate entities as instructed by the Trustee.
  • Assist in planning, preparing materials and speaking at training seminars for attorneys and paralegals conducted by the Trustee and update law library and research tools as necessary. 
  • Assist in matters related to conduit mortgages including Notices of Final Cure and Motions to Deem Mortgage Current and review creditor refunds to decide if a Motion to Redistribute Funds or a Trustee’s Motion to Modify is necessary.
  • Run and review monthly Red Flag Reports documenting pertinent case-specific information for the Trustee’s review and supervise Posting/Financial process and file appropriate motions to enforce policies and Debtor duties. 
  • Handle Requests for Tax Refunds and review cases for Notices of Plan Completion. 
  • Other duties may be assigned.  
 
Staff Attorney Requirements:
  • Bachelor’s Degree in Law required 
  • Law license required
  • Must be a member in good standing with the Texas Bar and the US District Court for the Southern district of Texas required
  • Experience with TNG software, Crystal Reports, SQL Queries, and the bankruptcy process preferred
